Your use of this Web site constitutes your agreement to all such terms, conditions, rules and notices. If you do not agree to these terms, conditions, rules and notices, you may not use this Website and you must exit this Website immediately.

Terms & Conditions

Please read these Terms and Conditons (hereinafter “Terms”, “Terms of Service”, “Booking conditions”, “Terms and conditons”, “Them”) carefully before using the www.absolutemorocco.com website and all other pages stemming from the above URL (hereinafter the “Service”, “Website”, “Site”) Fully accredited and licensed travel agency based in Morocco - (hereinafter “Absolute Morocco”, “Absolutemorocco”, “us”, “we”, or “our”).

Your access to and use of the Website is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

When you send us your initial deposit (or any subsequent payment) toward your arrangements price, the first named person on the booking agrees on behalf of all persons detailed on the booking that:

  • - He/she has read these terms and conditions and has the authority to and does agree to be bound by them;
  • - He/she consents to our use of information in accordance with our Privacy Policy.
  • - He/she is over 18 years of age and where placing an order for services with age restrictions declares that he/she and all members of the party are of the appropriate age to purchase those services; and
  • - He/she accepts financial responsibility for payment of the booking on behalf of all persons named on the booking

1. Booking, Pricing & Payment

Absolute Morocco will create an arrangement to suit your personal needs. A binding contract comes into existence between us upon the receipt of any monetary payment (either as a partial payment or in full) for that event. No contract will exist between the parties until such monies have been received.

To confirm an arrangement we require a non-refundable confirmation deposit. The amount of deposit varies depending on the nature of your event and will be confirmed to you before you book. This deposit allow us to start the reservation of all the elements of the arrangement. If you are booking 6 weeks or less before the starting date of your arrangement then full payment might be required at the time of booking.

Absolute Morocco services are priced in MAD (Moroccan dirham). Payments can be made by bank transfer, credit card, Western Union, or cash on site (subject to the consent of Absolute morocco). Our approach is to offer client with the best payment method that minimizes exposure to exchange rate fluctuations, transfer charges that may be incurred and maximizes your convenience. In all cases, a booking will not be confirmed until we are in receipt of cleared funds.

For your peace of mind, our website is protected by Let’s Encrypt, and all card payments are encrypted using the internationally accepted security system, SSL.

If full payment is not received on time communicated by Absolutemorocco at the moment of booking, Absolute Morocco reserves the right not to issue arrangement documentation and to release your reservations and assumes that the arrangement has been cancelled by you. In such circumstances cancellation charges will be applied as set out in Section 5 below.

Absolute Morocco acts solely as an intermediary for independent vendors and suppliers to book for the accommodations, restaurants, activities and other arrangements on your behalf. When you make a booking, you are entering into a contract with the accommodation or service providers via Absolute Morocco, not with Absolute Morocco. Absolutemorocco accept no responsibility for the acts or omissions of the parties or for the services provided by the parties and assume no responsibility for their actions or inactions, including delay, cancellation, overbooking, financial default or strike. The parties terms & conditions may apply to your booking and we advise you to read these carefully as they do contain important information about your booking.

In some case, Absolute Morocco will take a credit card number that is forwarded securely to the hotels or third parties to guarantee your booking. Any advance deposits, additional fees or charges will always be clearly marked before you make your booking. Once paid, these deposit payments, additional charges and fees are non-refundable in the event of cancellation. The needed deposit and balance will vary according to several criteria. Absolutemorocco will calculate and inform you at the moment of booking of the exact amounts needed to secure your bookings. For your security, payments online are made through secure servers using the internationally accepted security system, SSL.

Your booking is confirmed and a contract between you and the parties will exist when we send you confirmation on their behalf. Please check your confirmation carefully and report any incorrect or incomplete information to us immediately. Please ensure that names are exactly as stated in the relevant passport. As we act only as booking agent, we have no responsibility for any errors in any documentation except where an error is made by us.

For all arrangements and in all cases, where an offer of availability is made by the parties, your booking is not confirmed until you receive a booking confirmation. We therefore advise you to accept the offer as soon as possible after receipt in order to make a firm booking. You will be notified by email within 48 hours after receipt if your confirmation deposit whether your booking has been confirmed. It is your responsibility to contact Absolutemorocco if a confirmation email has not been received.

All currency conversions are based on data from local suppliers or banks and are only valid on the date of booking as a guideline. Payments are taken by parties in the parties’ local currency and may be subject to exchange-rate fluctuations (depending on the date charged) and charges from your bank or credit card issuer for which we have no liability. If you wish to avoid this by paying your booking to us one on site, please ask at the time of booking.

2. Insurance

It is essential and a condition of booking with Absolutemorocco, that you take out a comprehensive travel and medical insurance policy to cover you before, during and after your voyage in Morocco. You must be satisfied that your insurance fully covers all your personal requirements including pre-existing medical conditions, cancellation charges, medical expenses and repatriation in the event of accident or illness. We will not be liable for any losses howsoever arising and we will not be responsible for any costs incurred by you or any member of your party before, during or after your arrangement as a consequence of choosing to travel without adequate insurance cover or of inappropriate or insufficient travel insurance being purchased.

3. Medical Conditions and Disabilities

If you or any member of your party have any medical problem, reduced mobility, pregnancy, or disability which may affect your travel, it is extremely important that you tell us before you book so that we can advise as to the suitability of the chosen arrangements. In any event, you must give us full details in writing before you book in order to ensure that the arrangement is suitable for the given conditions. If full details are not given at the time of booking, we reserve the right to cancel in accordance with section 5 below and at no penalty to us when we become aware of these details.

All health and mobility information will only be used in order to advise you in relation to your booking and for passing to suppliers of your travel experience in accordance with our Privacy Policy.

By contacting us you certify that you nor to your knowledge anyone travelling with you, if applicable, has any physical or other condition or disability that would make travelling unsafe for you or other clients. It is your responsibility to ensure that you have received all appropriate vaccinations. Please consult your doctor before booking your arrangements with us and take all necessary precautions.

4. Documentation

Please carefully read your confirmation invoice, tickets and all other documentation we send you as soon as you receive them. Contact us immediately if any information appears to be incorrect as it may not be possible to make changes later. You will be responsible for any costs and expenses involved in rectifying any inaccuracies except where we made the mistake.

5. Cancellation by You

Cancellation of an arrangement must be made in writing and is effective from the date we receive the written notification. Upon cancellation, the deposit and any amendment charges will be forfeited. Cancellation charges are expressed at a percentage of quoted price as follows:

If the reason for cancellation is covered under the terms of your insurance policy you may be able to reclaim these charges. Notwithstanding the above, if we have issued airline tickets to you and you choose at any time to cancel them, then we will refund solely the amount of money we reclaim from the airline.

6. Amendments Reduction in Group size and transfers by You

Amendments

If you wish to change any part of your booking arrangements after a deposit has been made, we will endeavour to make the changes required, provided that the first named person on the booking provide a notification of the changes desired in writing. Whilst we will do our best to assist, we cannot guarantee that we will be able to meet your requested change. Where we can meet a request, we will allow you to make minor changes for free or we will charge you a fee of $150 for customer-initiated change to the booking after receipt of payment, and additional airline, hotel and/or supplier fees may also be charged. Any change made will result in the booking being re-priced at the rate in effect at the time of the change and additional deposit or balance payments may be required to confirm the change.

Reduction in Group size and transfers

If some member or members of your party cancel, the increased per person cost to run thearrangement for the reduced number of members will be calculated by our staff. The increase in cost per person will need to be covered by the first named person on the booking or the remaining travelers or the cancelling member(s).

You may transfer your booking to another person who satisfies all the conditions applicable to your arrangement contract providing we are notified not less than 91 days before the start of your arrangement and you pay an amendment fee of €75 per person transferring, meet all costs and charges incurred by us and/or incurred or imposed by any of our suppliers and the transferee agrees to these booking conditions and all other terms of the contract between us.

If you wish to no longer proceed, cancellation charges as set out will apply in order to cover our estimated costs. Otherwise, no refunds will be given for passengers not travelling or for unused services.

Note

Certain arrangements may not be amended or transferred after they have been confirmed and any alteration could incur a cancellation charge of up to 100% of that part of the arrangements.

7. Cancellation by Us

Whilst we hope we will never have to cancel your arrangement, this is very occasionally necessary and we reserve the right to do so. Absolute Morocco reserves the right to cancel or change any arrangement at any time, if your safety or the quality of the arrangement, in our sole opinion, is deemed to be compromised. If we cancel your trip, we will refund what you have paid us, but we cannot be held responsible for losses you may incur with third parties, such as airlines or hotels. For this reason we strongly recommend Cancellation & Interruption Insurance.

8. Amendments by Us

It is unlikely that we will have to make any changes to your arrangment although we reserve the right to make changes at any time. Most of these changes are minor and we will advise you of these in writing at the earliest possible date.

9. Unforeseeable Changes to Your arrangement

It is sometimes necessary (or recommended) that changes be made to your arrangement after it has been confirmed with your Confirmation Deposit. This is most common when a third party (i.e. airline, hotel) makes changes that are beyond our control, such as a flight cancellation or schedule change. In other instances, changes may be necessary due to extreme weather or events in the region. We will always do our best to rework the arrangement in a way that minimizes changes to the flow and pricing of your trip. However, if the itinerary changes require us to re-price your arrangement, you will be responsible for the difference in cost.

10. Risks

Absolutemoroccco Events and arrangements may involves travel, and travel involves risks. Our Events and arrangements are often off the beaten path and in developing regions with transportation, communication and healthcare standards that are different from what you may expect at home. Our events and arrangements may be physically demanding and there is a risk of serious personal injury, including permanent disability and death from accident, illness or the actions of negligence of other persons. Medical facilities and services may not be readily accessible and may not be sophisticated. As mentioned above, we also work with independent suppliers and third party service providers (hotels, local guides, transportation companies, airlines, tour operators) and cannot be held responsible for their actions or their failure to act. Absolutemorocco has no right or ability to control their operations and therefore makes travel arrangements for the events, arrangements, trips on the condition that Aboslutemorocco will not be liable for any act or omission of any independent supplier or any unrelated third party. The services provided by independent suppliers are subject to the laws of the place where the services are provided, and any conditions imposed by those suppliers. The liability of the independent suppliers may be limited by their tariffs, conditions of carriage, tickets and vouchers, and international conventions and agreements.

11. Force Majeure

Absolutemorocco will not be liable or pay you compensation if our contractual obligations to you are affected by any event which we or the supplier(s) of the service(s) in question could not, even with all due care, foresee or avoid. These events can include, but are not limited to war, threat of war, civil strife terrorist activity and its consequences or the threat of such activity, riot, the act of any government or other national or local authority including port or river authorities, industrial dispute, lock closure, natural or nuclear disaster, fire, chemical or biological disaster and adverse weather, sea, ice and river conditions and all similar events outside our or the supplier(s) concern’s control. Advice from the Foreign Office to avoid or leave a particular country may constitute Force Majeure

12. Limitation of Liability

To be eligible to take an Aboslute Morocco arrangement, Clients must accept the risks of travel, including those set out in “Risks”, in “Force Majeure”, and otherwise set out in these Terms & Conditions, and assume full responsibility for any loss, injury, death or damage to them, their family or their dependants or property arising in connection with their participation, or the participation of their family, in the arrangement. You must have their own insurance appropriate to their needs and the needs of their family or dependants in respect of such loss, injury, death or damage.

The cost of all Absolute Morocco arrangements is based on Clients agreeing to these Terms & Conditions and in particular this Limitation of Liability, Release and Indemnity. As Absolutemorocco is acting solely as an agent of you with respect to all transportation, accommodations, meals and other arrangements, in consideration for participating in the arrangementss, Clients agree not to sue Absolute Morocco, its employees, directors, successors, agents and assigns in respect of, and forever release them from, all liability for economic loss and physical or mental injury, direct or indirect, arising in connection with the arrangement and the actions of any third party service providers—including, without limitation, permanent disability and death; any emotional distress; any loss of services, financial support, aid, consortium or companionship; and any damage to or loss of property—in each case even if caused in whole or in part by the conduct, including the negligence, of Absolutemorocco. You further agree that they will indemnify and hold Absolutemorocco harmless in respect of any claims arising in connection with the arragement made by: i) third parties, which arise from the misconduct of the Clients;  ii) the Client’s family members, dependants or heirs; iii) third parties, which the Client, their estate, their family members, dependants or heirs have sued, if damages are recovered from such third parties, to the extent the third party obtains any indemnification from Absolutemorocco. Absolutemorocco reserves the right to decline accepting any Client whose health or actions in Absolutemorocco’s sole judgement impede the operation of an arrangement or the welfare or enjoyment of fellow Clients.

In addition and without limitation, Absolutemorocco is not responsible for any injury, loss, or death, or damage to property in connection with the provision of any goods or services whether resulting from, without limitation, to acts of God or force majeure, weather, quarantines, illness, disease, acts of war, civil unrest, insurrection/revolt, animals, labor unrest including strikes, criminal or terrorist activities of any kind, overbooking or downgrading of services, food poisoning, mechanical or other failure of means of transportation or travel delays, travel advisories or warnings.

13. Assistance

Whether or not we are liable for compensation, we will always provide you with appropriate assistance without undue delay if you are in difficulty. This will include providing appropriate information on health services, local authorities and consular assistance, assisting you to make distance communications and helping you to find alternative arrangements. We may charge you a reasonable fee for such assistance if the difficulty is caused intentionally by you or through your negligence.

14. Problems

If you have a problem during your arrangement, please inform the relevant organiser (camp/hotel manager/service provider) immediately and they will endeavour to put things right. If your problem cannot be resolved locally you must send full details to us in writing immediately. If you fail to follow this procedure, we will not accept liability as we have been deprived of the opportunity to investigate and rectify the problem.

15. Miscellaneous

Any purchase of goods or services which you make while in Morocco for your arrangement are solely at your risk, including, without limitation, such problems as defects, failure to ship or damage to goods while in shipment, whether or not the purchase was made from a vendor recommended by a guide, other person rendering travel or event services or any third party. You agree that if you are injured or become ill, Absolute Morocco may, at your cost, attempt to arrange medical treatment, evacuation or any other emergency services on your behalf as it deems essential for my safety and well-being but it accepts no responsibility for the quality or adequacy of any such treatment, evacuation or services. Baggage is carried entirely at your risk. We, and your local operators of events, tours and/or suppliers of services reserve the right to remove anyone from a trip without refund who acts in a manner which it considers unsafe or inconsiderate to fellow travellers or others and/or who ignores the requests of his or her guide(s) to act in a safe and considerate manner.

16. Carriers

Carriage by air, and sea is subject to the terms and conditions of the carriers with whom you are travelling and to international conventions. We accept no liability whatsoever for cancellations, strikes, timetable changes, diversions, technical issues unrelated to us, lost or mislaid luggage, rescheduling costs, missed accommodation, or delays which result from any operational decision of the carrier concerned. We accept no liability for death, injury or illness that derives from carriage by air or sea.

17. The Law

The above booking terms and conditions together with all correspondence form part of your contract with us. This contract and any matters arising from it shall be governed by and interpreted in accordance with the laws of the State of Laayoune, Morocco.

18. Your responsibilities

Absolute Morocco is committed to making your arrangement as rewarding and fun as possible. But we require your help to do so.

To be able to book your arrangement(s), event with us, it is your responsibility to:

  • - Ensure that your visas, passports, vaccination certificates and other health documents are in order and that you ensure that you have taken the advice of your primary care physician with regard to inoculations before departure. We will offer general advice but cannot be held responsible if you do not comply with current requirements before your departure. We do not accept liability for any advice given of a general nature prior to the travel commencing. You are responsible for a timely check-in for all flights and for presenting yourself to take up all pre-booked components of your travel and arrangement. No credit or refund will be given to you should you fail to take up any component of your travel or if you lose any travel documents. We highly advise you to contact the appropriate embassy(ies)/consulate(s) in your country of residence. Absolute Morocco is not responsible for any decisions, changes, costs, actions, losses or delays in relation to incomplete, expired or inaccurate travel documentation or any failure by you to obtain or carry the correct documentation and the consequential effect it may have on the visit itself. We draw your attention to the fact that there are certain inherent risks involved in all of the arragements that we supply and these must be accepted by you at your own risk.
  • - Provide us with as necessary information such as your personal information (age, passport & flight details, allergies, etc.) and travel preferences (type of bed, dietary needs, special interests, etc.) before confirming your booking and respond to our questions in a timely manner so as not to delay the planning process.
  • - Keep up to date with the latest travel alerts and warnings for Morocco. Absolute Morocco will do it’s best to keep you informed of major developments but you must contact your relevant government agency to be aware of any travel advisories and warnings. Should you choose to ignore such travel advisories and warnings, you assume all risk of personal injury, death or property damage that may arise out of events advised or warned against.
  • - Ensure that you have received all appropriate vaccinations and that anyone travelling with you, if applicable, has any physical or other condition or disability that would make travelling unsafe for you or other Clients. Please consult your doctor before travelling with us and take all necessary precautions.
  • - Acknowledge that travel insurance is mandatory on all of our arrangements. Particular care should be taken to ensure that you have adequate cover, in particular for cancellation and emergency repatriation in the event of medical problems. In some developing moroccan regions, medical facilities and services may not be readily accessible and may not be sophisticated. Our arrangements may be physically demanding and there is a risk of serious personal injury, including permanent disability and death from accident, illness or the actions of negligence of other persons. Clients must have their own insurance appropriate to their needs and the needs of their family or dependants in respect of such loss, injury, death or damage.

19. Your Behavior

All Clients booking with us are expected to conduct themselves in an orderly and acceptable manner and not to disrupt the enjoyment of other Clients. If in our opinion or in the opinion of any of the parties’ managers or any other person in authority, your behavior or that of any member of your party is causing or is likely to cause distress, danger or annoyance to any of our other guests or any third party or damage to property, or to cause a delay or diversion to transportation, we reserve the right to terminate your booking arrangements with us immediately. In the event of such termination our liability to you and/or your party will cease and you and/or your party will be required to leave your accommodation or other service immediately. We will have no further obligations to you and/or your party. No refunds for lost accommodation or any other service will be made and we will not pay any expenses or costs incurred as a result of termination. You and/or your party may also be required to pay for loss and/or damage caused by your actions and we will hold you and each member of your party jointly and individually liable for any damage or losses caused by you or any member of your party. Full payment for any such damage or losses must be paid directly to the parties’ manager or other supplier prior to departure from the parties. If you fail to make payment, you will be responsible for meeting any claims (including legal costs) subsequently made against us as a result of your actions together with all costs we incur in pursuing any claim against you. We cannot be held responsible for the actions or behavior of other Clients or individuals who have no connection with your booking arrangements or with us.

20. Our Responsibilities

Absolute Morocco recognizes the faith and trust you put in us to excute your arrangements. We will do our greatest possible to deliver the perfect arrangements for you.

We ensure you that:

  • - We will respond to your messages promptly and will keep you informed as your arrangement(s) evolves. If at any time you have questions or concerns we ask that you let us know immediately so we can address them.
  • - The process of booking your arrangements in Morocco requires that we use the personal data you provide such as your name and email address. In addition, we may need some sensitive personal data such as special needs or dietary preferences etc. This information is passed on to the airlines and hotels and any other suppliers of your packages on a ‘need to know’ basis in order to excute your arrangements. We will however not pass your information on to any person not responsible for part of your travel arrangements unless required to do so by law. By sending us your initial deposit, you are consenting to Absolute Morocco collecting and using your personal information as required to plan your arrangement and provide you with proper services.

21. Complaints

If you perceive any lack of conformity during your arrangement, please inform us or the relevant supplier (e.g your hotelier) immediately who will endeavour to put things right. If your complaint is not resolved locally, please contact us immediately so that we will have an opportunity to quickly remedy the problem, correct the matter whilst you are away and make any alternative arrangements that may be necessary. If you fail to follow this procedure, we will have been deprived of the opportunity to investigate and rectify your complaint at the time the problem occurred and this may affect your rights under this contract.

If you have any special requests (for example dietary requirements, cots or room location), please let us know at the time of booking in written by email. We will pass on all such requests to the supplier, but we can’t guarantee that they will be met and we will have no liability to you if they are not.

22. Privacy

Your privacy is important to us. Absolutemorocco is required to collect personal information (such as passport details) in order to plan your trip. We appreciate the sensitive nature of this information and will never share it with third parties other than as required for booking air, hotel or other reservations as a part of your arrangement. By contacting us, you are consenting to Absolutemorocco collecting and using your personal information as required to plan your arrangement and provide you with proper services.
